Care On Call is committed to protecting the privacy, dignity, and legal rights of every client we serve. By engaging with our services, you agree to the following terms, which govern the collection and use of information, service delivery, and mutual responsibilities. These terms are legally binding and governed by the laws of the State of Texas.

1. Information Collection & Use

We collect personal, logistical, and household information solely to deliver tailored, high-quality support. This may include preferences, schedules, health-related details, and behavioral insights. All data is collected with consent and used exclusively to support your care. We do not sell, lease, trade, or share your information with third parties under any circumstances.

2. Client Responsibilities and Conduct

Our clients are discerning individuals who seek peace of mind, personalized attention, and effortless living. To uphold these standards, we ask that all clients and their representatives embrace the following principles:

  • Transparency & Truthfulness: Provide complete and accurate information to ensure we may tailor every detail of your care with precision.

  • Residence Readiness: Maintain a safe, orderly, and respectful environment that reflects the quality of service provided.

  • Graceful Engagement: Interact with our staff as partners in care—free from harassment, hostility, or inappropriate demands.

  • Elegance in Boundaries: Recognize that our services are purely non-medical; we are not a clinical provider and do not substitute for medical care.

  • Confidential Living: Respect the discretion of our team. No recordings, photography, or social sharing without express written authorization.

  • Financial Etiquette: Honor payment schedules and service terms outlined in your Service Agreement. Promptness and transparency ensure uninterrupted care.

  • Upholding Trust: Refrain from behavior that may jeopardize staff safety, interfere with care delivery, or reflect poorly on the mutual values we share.

  • Any deviation from these expectations may result in formal notice, service pause, or termination—consistent with Texas Administrative Code §553 guidelines.

3. Limitation of Liability

Care on Call delivers its bespoke services with great care, but makes no guarantee of medical outcomes, nor accepts liability for clinical or third-party interventions. To safeguard our team and uphold our standard of excellence, the following shall apply:

  • Services are rendered “as-is” and “as-available”, grounded in hospitality and lifestyle support—not medicine or therapy.

  • We assume no liability for injury, illness, delays, dissatisfaction, or financial loss not resulting from legally defined gross negligence or willful misconduct, per Texas Civil Practice & Remedies Code §41.001.

  • We do not provide refunds, reimbursements, or compensation for incidental or consequential outcomes unless required by court order.

  • Clients agree that:

    • All clinical needs fall outside our scope, and licensed professionals must be consulted for diagnosis or treatment.

    • Care on Call shall never be obligated to pay or settle any claim beyond what is required under Texas law.

    • If a client breaches this agreement, causes reputational or operational harm, or defaults on payments, Care on Call reserves the right to seek full recovery of actual damages, legal fees, interest, and costs under Texas Civil Practice & Remedies Code §§38.001–38.005.

    • In any case, our maximum total liability shall never exceed fees paid in the prior 90 days
